By accessing or using LeadPing, a product by Kiyana Infotech, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

• Optional hosted form builder
• Real-time notification delivery via WhatsApp
• Dashboard for managing webhook configurations

User Accounts

To use LeadPing, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental/guardian consent
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these terms.

Acceptable Use

When using LeadPing, you agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Send spam, malicious content, or unsolicited messages
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the service or servers
• Use the service to collect or harvest personal information without consent
• Violate any applicable laws or regulations

Service Availability

We strive to maintain high availability of our service, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or system failures
• Third-party service disruptions (including WhatsApp)
• Force majeure events

We are not liable for any loss or damage resulting from service unavailability.

Pricing and Payment

LeadPing offers various pricing plans. By subscribing to a paid plan, you agree to:

• Pay the applicable fees for your chosen plan
• Provide accurate billing information
• Authorize automatic recurring payments (where applicable)

We reserve the right to modify pricing with 30 days' notice to existing subscribers. Refunds are provided at our discretion and in accordance with our refund policy.

Data and Privacy

Your use of LeadPing is also governed by our Privacy Policy. Key points include:

• We do not store enquiry data (form submissions) on our servers
• Enquiries are delivered directly to your WhatsApp in real-time
• We retain only account information and webhook configurations
• You are responsible for securing your WhatsApp account

Intellectual Property

The LeadPing service, including its design, code, and content, is owned by Kiyana Infotech and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our service without permission
• Reverse engineer or attempt to extract source code
• Use our trademarks or branding without authorization

Third-Party Services

LeadPing integrates with third-party services, particularly WhatsApp. Your use of these services is subject to their respective terms and conditions. We are not responsible for:

• Changes to third-party services or their availability
• Third-party service violations or data breaches
• Content or behavior on third-party platforms

Limitation of Liability

To the maximum extent permitted by law, Kiyana Infotech and LeadPing shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or data transmission errors
• Actions taken by third-party services

Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Kiyana Infotech, LeadPing, and its affiliates from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any rights of another party

Termination

Either party may terminate this agreement at any time:

• You may cancel your account through your dashboard or by contacting support
• We may suspend or terminate your account for violation of these terms
• We may discontinue the service with 30 days' notice

Upon termination, your access to the service will cease, and we may delete your account data in accordance with our data retention policies.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. Continued use of the service after changes constitutes acceptance of the new terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction in India.
